Terms of Service

1. Acceptance

By accessing or using Alpenroute ("the Service"), you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service — entertainment use only

Alpenroute is a personal, non-commercial hobby project provided purely for entertainment and demonstration purposes. It is not a travel agency, tour operator, navigation service or professional planning tool, and must notbe used to plan, organise or undertake real trips. Any routes, distances, mountain-pass information, weather snapshots, hotel suggestions and AI-generated itineraries shown by the Service are illustrative only and may be incomplete, inaccurate, outdated or unsafe.

3. No warranty

The Service is provided strictly "as is" and "as available", without any warranty of any kind, whether express, implied or statutory, including but not limited to warranties of accuracy, completeness, reliability, availability, fitness for a particular purpose, merchantability, or non-infringement. You must independently verify any information before relying on it for any purpose.

Riding motorcycles, especially on mountain roads, is inherently dangerous. You alone are responsible for your safety, your equipment, compliance with traffic laws, and any decision to ride.

4. Limitation of liability — no responsibility

To the maximum extent permitted by applicable law, Takis Charakas, the operators, contributors and affiliates of Alpenroute accept no responsibility and no liability whatsoever for any direct, indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to personal injury, death, property damage, accidents, loss of data, loss of profits, missed connections, travel costs, or any other loss or harm, arising out of or in any way connected with your access to or use of the Service, your reliance on any information shown by the Service, or your inability to use the Service.

By using the Service you expressly acknowledge that you do so entirely at your own risk and you waive, release and hold harmless Takis Charakas and the operators of the Service from any and all claims related to such use.

5. Express waiver and release of claims

You expressly and irrevocably waive, release, discharge and forever hold harmless Takis Charakas, the operators, contributors, agents and affiliates of Alpenroute (the "Released Parties") from any and all claims, demands, actions, causes of action, lawsuits, damages, losses, costs and expenses (including legal fees), of any nature whatsoever, whether known or unknown, anticipated or unanticipated, that you, your heirs, successors or assigns may have or claim to have against the Released Parties, arising out of or in any way connected with:

  • your use of, or inability to use, the Service;
  • any route, distance, mountain-pass status, weather, hotel suggestion, AI-generated itinerary or other information shown by the Service;
  • any trip, ride, drive, journey or travel undertaken in reliance, in whole or in part, on the Service;
  • any accident, collision, crash, injury (including death), illness, property damage, theft, loss of belongings, mechanical failure, vehicle damage, traffic violation, fine, border-crossing issue, road closure, weather event, missed booking, missed connection, cancellation, delay, additional cost or any other incident or harm of any kind;
  • actions or omissions of third parties (including other road users, rental providers, hotels, public authorities and emergency services).

This waiver applies whether such claims are based on contract, tort (including negligence), strict liability, statute or any other legal theory, and applies to the maximum extent permitted by applicable law.

6. Assumption of risk

You acknowledge that travel — and motorcycle riding on mountain roads in particular — involves serious and inherent risks of accident, injury and death. You voluntarily assume all such risks. You confirm that you alone are responsible for your own safety, your equipment, your route choices, compliance with all laws and regulations, adequate insurance, and any decision to travel or ride.

7. Indemnity

You agree to indemnify, defend and hold harmless the Released Parties from and against any and all third-party claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your reliance on its content, any trip you undertake in connection with it, or your breach of these Terms.

8. No professional advice

Nothing on the Service constitutes professional travel, navigation, safety, medical, legal or insurance advice. Always consult qualified professionals and official sources (national road authorities, weather services, your insurer) before any real journey.

9. Acceptable use

You agree not to: (a) abuse, overload or attempt to break the Service; (b) scrape or copy content at scale; (c) use the Service for unlawful purposes; (d) impersonate others or misrepresent your affiliation.

10. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account.

11. Intellectual property

The Service, its design and original content are protected by copyright. Map data is provided by OpenStreetMap contributors under the ODbL. Third-party trademarks belong to their owners.

12. Changes to the Service or Terms

We may modify or discontinue the Service or these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of the Republic of Cyprus, without regard to conflict-of-laws rules. The courts of Nicosia, Cyprus shall have exclusive jurisdiction to settle any such dispute or claim, save that mandatory consumer-protection rights of your country of residence remain unaffected.
